Another Man's Treasure Terms and Conditions

Welcome aboard Another Man's Treasure, a purpose-driven online resale platform where every transaction supports a greater good. These Terms and Conditions govern your access to and use of our website, services, and all transactions conducted through the platform. By using our platform, you agree to abide by the following Terms:

1. Overview

AMT operates as a curated resale marketplace that allows individuals (Sellers) to submit pre-owned, high-value goods to be refurbished and sold to new owners (Buyers), with a significant portion of proceeds going to charitable causes. We facilitate the sale, manage fulfillment, and provide donor acknowledgment for charitable contributions. AMT does not, at any point, take ownership of the products submitted by sellers. Legal ownership of each item remains with the seller until the item is purchased.

2. Eligibility

By using AMT, you represent that you are at least 18 years old, legally capable of entering into a binding agreement, and that the items you submit are lawfully owned by you and not counterfeit, stolen, or otherwise in violation of applicable laws or third-party rights.

3. Item Submission & Evaluation

• Sellers submit items via the Treasure Form, including clear images and descriptions.
• AMT reviews submissions and responds within a reasonable timeframe to approve or reject based on condition, value, and marketability.
• Items typically accepted include footwear, jewelry, designer accessories, watches, and collectibles with an estimated resale value of $200 or more.
• AMT reserves the right to refuse any item at its sole discretion.

4. Listing and Pricing

• Approved items will be listed on the AMT website by our team.
• AMT sets the final listing price based on market research, item condition, brand demand, and resale potential.
• Sellers may provide pricing input but acknowledge that AMT retains control over final listing and promotional strategies.

5. Charitable Contribution and Revenue Allocation

• By default, 50% of the net sale proceeds are donated to a registered nonprofit organization of the seller's choice.
• 25% of the proceeds go to the seller, and 25% to AMT to cover operational expenses.
• Sellers may opt to increase their charitable contribution up to 75%, but must contribute a minimum of 25%.
• Shipping and verification/refurbishment expenses are deducted from the charitable portion of the sale.

6. Sale Process and Fulfillment

• When a buyer purchases an item, AMT notifies the seller and provides a prepaid shipping label.
• Sellers must ship the item within 5 calendar days of notification.
• If the item is not shipped in time, the sale may be canceled and the listing removed.
• Upon receipt, AMT inspects and, if applicable, refurbishes or verifies the item before shipping it to the buyer.
• All shipping, handling, and verification costs incurred by AMT are absorbed by the charitable contribution and will be deducted accordingly prior to donation disbursement.

7. Authentication and Refurbishment

• AMT reserves the right to authenticate high-value items (e.g., luxury watches, designer handbags).
• Items may undergo light refurbishment such as cleaning or polishing.
• AMT does not guarantee restoration or manufacturer-level repair.

8. Returns and Refund Policy

All sales are final. AMT does not offer returns or refunds except in cases where the item received by the buyer is materially different from its listing description. Disputes will be handled at AMTs sole discretion. Refunds are issued only when justified by clear misrepresentation.

9. Promotional Product Disclaimer - Jordan 1 Giveaway

As part of our launch campaign, AMT is donating up to 400 pairs of authenticated sneakers (primarily Jordan 1s and other collectible models) acquired from an independent third-party seller. These sneakers have been verified by external professional authentication services and passed industry standards for resale. While we do not possess original purchase receipts, they have been legally acquired through private sellers and vetted through multiple verification sources.

• 1 out of 5 approved sellers whose item has sold through AMT will receive one pair of these sneakers free of charge, donated by the founder, as part of our launch campaign.
  
• These sneakers are provided as a promotional gift and carry no retail value on AMTs balance sheet. They are not intended to be resold through AMT.
• AMT makes no warranty of brand affiliation or resale value of these promotional items. Use or resale of the sneakers is at the recipient's sole discretion.

10. Commemorative Doubloons and Recognition

• AMT issues custom gold doubloons to both buyers and sellers upon successful sale, engraved with the amount donated to charity.
• These are tokens of appreciation and have no monetary value.
• Sellers also receive IRS Form 8283 for tax purposes where applicable.

11. Tax and Legal Compliance

It is the seller's responsibility to ensure they are eligible to claim any charitable deductions. AMT does not provide tax advice and disclaims liability for any tax-related issues. All parties must comply with local, state, and federal laws in relation to ownership, transfer, and sale of goods.

12. Seller Representations and Warranties

• The seller affirms that submitted items are owned by them, free of liens, and are authentic.
• No item may infringe on the intellectual property or rights of third parties.
• Fraudulent submissions will result in removal from the platform and may trigger legal action.

13. Limitation of Liability

• AMT is not responsible for loss, theft, or damage of items in transit unless shipped using our provided label.
• AMT disclaims liability for delays in refurbishment, authentication, or shipping due to factors outside our control.
• Our maximum liability for any claim related to a transaction is limited to the amount AMT received in commission for that transaction.

14. Community Conduct and Ethics

AMT is built and staffed by individuals in recovery and operates with values of honesty, second chances, and respect. Users agree to interact with AMT staff and one another with empathy, professionalism, and integrity.

15. Intellectual Property

All AMT logos, branding, slogans, images, and content are property of Another Man's Treasure and may not be reused without permission. Submitted item content (images/descriptions) may be reused in marketing or resale listings, with credit given to the seller where applicable.

16. Modifications to the Terms

AMT reserves the right to modify these Terms at any time. We will notify users of changes via the website or email. Continued use after updates constitutes acceptance.

17. Termination

AMT may suspend or terminate a user's access for any violation of these Terms, fraudulent activity, or abusive conduct. Sellers may also request to withdraw from the platform at any time.
